Judicial record to be displayed as a built-in data field on citizen’s VNeID

The National Assembly (NA) held a plenary discussion on the draft Law amending and supplementing several articles of the Law on Judicial Records on the afternoon of November 17, in Hanoi.

On behalf of the law-drafting agency, Member of the Politburo and Minister of Public Security General Luong Tam Quang provided additional explanations to NA deputies on the draft law.

Regarding the purpose of building in judicial records on the citizen’s VNeID, the minister said that the Ministry of Public Security would carefully study NA deputies’ opinions and revise the draft law. He added that, as judicial records and judicial record certificates are built in on the citizen’s VNeID, citizens can easily access their own judicial record information while doing administrative procedures. With the built-in information, public officials and civil servants will not need to request judicial record certificates from the authority to hand them to their personnel management agencies.

According to Minister Luong Tam Quang, the draft law has regulations allowing State agencies, political organizations and the Vietnam Fatherland Front to access citizens’ judicial record information upon request for a connection to the Judicial Records Database and the National Population Database, while the organizations and agencies need the information for their personnel management.

Regarding Judicial Record Certificate No. 1, Certificate No. 2 and the electronic judicial record certificate, based on the opinions of National Assembly deputies, the Ministry of Public Security will revise the draft law so that judicial record information displayed on VNeID is recognized as a built-in data field, similar to the citizen’s full name or date of birth.

This information will carry the same legal validity as a judicial record certificate, so citizens will no longer need to apply for a paper-based judicial record certificate.

The judicial record information will be protected by authentication and anti-forgery technologies, along with mechanisms to verify the electronic certificate for agencies and organizations.

For other specific issues, the Minister affirmed that the Ministry of Public Security will study and fully incorporate the recommendations of NA deputies and report to the Government for further refinement of the draft law.
