NA Standing Committee briefed on draft Law on Road Traffic Order and Safety

Continuing its 48th session, the National Assembly’s (NA) Standing Committee listened to a report on the draft Law on Road Traffic Order and Safety presented by Major General Nguyen Duy Ngoc, Deputy Minister of Public Security, on September 16.

According to Major General Ngoc, the promulgation of the Law on Road Traffic Order and Safety will contribute to effectively implementing Directive No. 18-CT/TW of the Party Central Committee’s Secretariat on strengthening the Party's leadership over the work of ensuring road, railway, and inland waterway traffic order and safety and reducing traffic congestion.

The Deputy Minister of Public Security emphasized that the 2008 Law on Road Traffic regulates two large and different fields: Maintenance of traffic order and safety; and investment, development, and management of road traffic infrastructure. 

According to him, these two major different fields should not be included in one law as this would lead to a lack of important contents of the two fields.

Further, the draft Law on Road Traffic Order and Safety also includes provisions of protecting human rights and ensuring safety for traffic participants while the amended 2018 Law on Road Traffic aims at issues such as investment, construction, development of traffic infrastructure and management of road transportation, meeting the requirements of socio-economic development.

During the process of drafting the bill, the Ministry of Public Security has referred to the legal documents on traffic safety and transportation of other countries such as South Korea, Japan, Singapore, Russia, Germany, Australia, and realized that they all have a law on traffic order and safety separate from laws on construction and development of traffic infrastructure and management of road transportation.

Additionally, the draft Law designates the State agencies that are responsible for granting vehicle registration licenses and plates as well as responsibilities of vehicle owners in line with the 1968 Vienna Convention on Road Traffic as well as practices in Vietnam.

The draft Law also revises types of driving licenses in consistency with the 1968 Vienna Convention.
