Law on guard force submitted to the NA

PSNews - Senior Lieutenant General To Lam, Politburo’s member, Minister of Public Security on behalf of the Government presented the Bill on the Guard Force to the National Assembly on October 31.

According to Minister To Lam, the Ordinance on the Guard Force issued in 2005, is providing an important legal foundation for the force to fulfill its assigned tasks, helping firmly protect the Party, the State, national security and social order and safety.

In recent years, although domestic, regional and global situations saw complex developments, requiring the Guard Force of increasing missions, the force has maintained absolute safety for Party and State leaders, international delegations and all important political, cultural and social events of the country.

However, the highest legal document on the Guard Force is only an ordinance so its enforcement and execution are not on a par with the position, functions, duties and powers of the Guard Force in the current context.

The realities require to build and promulgate a law on the guard force to concretize related articles in the 2013 Constitution.

The law will also facilitate the force’s security safeguarding activities and ensure human rights and citizens’ rights as stipulated in the Constitution.

When the bill is approved, it will ensure the legal framework and create a more solid favorable conditions for the force to fulfill its assigned missions.

The bill comprises 6 chapters with 36 articles.

Accordingly, the Guard Force is determined as a specialized force under the Ministry of Public Security and the Ministry of Defense. With the main task is to protect the National Security, the Guard Force will have a legal framework to take necessary measures to ensure absolute security for objects as prescribed in the Law.

The bill also has changes in the powers of guard forces, which allow guard forces to use special licenses, technical and professional tools, weapons and transit signal priority when executing their missions.

The bill also defines that all cooperation, coordination and collaboration activities as well as joint operation between the Vietnamese guard forces and foreign guard forces inside Vietnam’s soil or in foreign countries must follow the international conventions with Vietnam’s membership or agreements signed by Vietnam and other countries in line with Vietnam’s laws.
