Process of arrest and assets revocation of Trinh Xuan Thanh

If Trịnh Xuân Thanh is staying countries which have yet to be a signatory of mutual legal assistance treaty in criminal matters, the arrest and extradition will face difficulties, but not become a deadlock.

Major General Trần Thế Quân - Deputy Director of Legislation and Judicial Administrative Reform Department (Ministry of Public Security) responded to the press to day. At present, Trinh Xuân Thanh is supposed to flee to and hide in Germany. However, Vietnam and Germany have not signed any treaty on judicial assistance, which will exert certain difficulties, but no deadlock is ensured, says Major General.

According to Major General Trần Thế Quân, though Vietnam has not signed the Treaty with certain countries, the arrest and extradition will still be proceeded thanks to other relevant international treaties of which the two sides are signatories.

Accordingly, the extradition can be implemented based on agreement between the two governments, on the basis of the principle of reciprocity, but not against the laws of Vietnam, international laws and practice.

Responding to the question over the plan to arrest and extradite if Trịnh Xuân Thanh had fled to Canada or some other country that has not signed the mutual assistance treaty in criminal matters with Vietnam, Mr. Quân said that such activities would face much more obstacles, but not a deadlock. In such circumstance, we will resort to diplomatic relations between the two countries, mutual discussions and negotiations..

Supposed that Thanh is hiding in countries and territories to which Vietnam has signed the agreement on Mutual Legal Assistance on criminal extradition such as Korea, Russia, Poland, Laos, etc. Vietnam will cooperate with such nations to extradite him back to Vietnam.

As a matter of fact, if Thanh’s offense is identified it is likely to be corruption. In such case, no countries and territories tolerate such crime. Therefore we hope that effective cooperation will be conducted to extradite Thanh back to Vietnam.
