Law on Extradition, Law on Transfer of Sentenced Persons submitted to NA for approval

Under the authority of the Prime Minister, Member of the Politburo and Minister of Public Security General Luong Tam Quang delivered summary reports on two law projects, namely the Law on Extradition and the Law on Transfer of Sentenced Persons to the National Assembly (NA) at its 9th session, on the morning of May 24, 2025.

In his summary reports of the two draft laws, Minister Luong Tam Quang underscored that the Law on Extradition is critically necessary to improve the legal framework on extradition in a consistent and contemporary manner, as well as to ensure legal coherence, feasibility and alignment with the domestic legislation and international practices.

The new Law on Extradition would help promote international cooperation in extradition and provide a legal foundation for the country to negotiate and implement extradition treaties, he added.

The Minister revealed that the draft Law on Extradition comprises 4 chapters and 45 articles, amending 19 articles, adding 10 new articles and removing one article from the 2007 Law on Legal Assistance regarding extradition.

The draft law stipulates that the Government will exercise the overall State management of extradition, while the Ministry of Public Security will be responsible to the Government for the execution of the State management function in this field.

Regarding the draft Law on Transfer of Sentenced Persons, Minister Luong Tam Quang stated that the legislation aims to remove obstacles to the implementation of the 2007 Law on Legal Assistance, meeting the evolving requirements of legal and judicial reform and international integration in accordance with the Party’s and the State’s policies.

The draft Law on Transfer of Sentenced Persons consists of four chapters and 45 articles, revising 14 articles, adding 18 new articles, and removing five articles and two regulations from the 2007 Law on Legal Assistance.

Article 6 of the draft law designates that the Ministry of Public Security as the Central Authority of the Socialist Republic of Vietnam is responsible for the transfer of sentenced persons.
