MIC to strictly handle violations of cross-border information services

PSNews – The Ministry of Information and Communications (MIC) has just made public for comments the Draft Decree amending and supplementing Government’s Decree No. 72 and Decree No. 27 on the management, provision and use of Internet service and online information. 

The ministry proposes that businesses providing cross-border information services must comply with the Vietnamese laws and the regulations issued by competent Vietnamese management agencies.

In particular, cross-border information services with more than 100,000 regular visitors per month must notify and have their operation approved by the MIC.

They must prevent and remove all violating contents or services within 24 hours upon request from Vietnamese competent authorities, at the same time complying with specialized regulations when providing cyber information services in Vietnam.

Only licensed channels and accounts of cross-border social networks are able to live-stream and access revenue-generating services.

Violating contents on live-streams of foreign organizations and individuals must be removed within 3 hours since the network provider receives a request from the Vietnamese authorities.

Foreign social network accounts, community online pages and content channels that regularly post illegal contents shall be temporarily blocked within 24 hours since the network provider receives a request from the MIC.

Foreign online applications that violate the Vietnamese laws must be removed from the app store within 24 houses since the provider receives a request from the MIC. 

Regarding users of cross-border online information services, MIC requires account owners, community page owners and content channel owners to be responsible for the contents posted on their accounts.

They must remove violating contents or information that affects the lawful rights and interests of other organizations and individuals, and information that affects children within 3 hours upon requests of affected users or management agencies.
