Joint circulars on coordination of competent authorities in criminal procedures issued

The Ministry of Public Security, the Ministry of National Defence, the Supreme People’s Procuracy and the Supreme People’s Court co-held a ceremony to sign joint circulars stipulating the coordination among competent authorities involved in criminal procedures, on the afternoon of February 26th, in Hanoi.

Member of the Politburo and Minister of Public Security General Luong Tam Quang, Secretary of the Party Central Committee and Chief Justice of the Supreme People’s Court Le Minh Tri, and Prosecutor General of the Supreme People’s Procuracy Nguyen Huy Tien co-chaired the ceremony.

The event also saw the presence of Deputy Minister of Public Security Senior Lieutenant General Le Quoc Hung, Deputy Minister of Public Security Lieutenant General Nguyen Van Long, Deputy Minister of National Defence Senior Lieutenant General Vo Minh Luong, Deputy Chief Justice of the Supreme People’s Court Nguyen Quoc Doan, Deputy Chief Justice of the Supreme People’s Court Nguyen Van Tien, and Deputy Prosecutor General of the Supreme People’s Procuracy Ho Duc Anh, among others.

Delivering his opening remark, Deputy Minister Nguyen Van Long revealed that the central judicial agencies have worked closely together to develop joint circulars regulating the coordination of the competent authorities involved in criminal procedures, over the past time.

Accordingly, the first joint circular stipulates the coordination mechanisms among the competent authorities involved in criminal procedures, the management and execution of temporary detention and custody as well as the execution of criminal judgments in the context that district-level police units are dismissed.

Meanwhile, the second one includes detailed regulations and guidelines on the implementation of Article 3 of Resolution No. 164/2024/QH15 issued by the National Assembly on November 28th, 2024, regarding pilot approaches to handling evidence and assets during investigation, prosecution and trial of certain criminal cases.

At the ceremony, the leaders of the Ministry of Public Security, the Ministry of National Defence, the Supreme People’s Procuracy and the Supreme People’s Court signed the joint circulars.

Speaking at the ceremony, Minister Luong Tam Quang underlined that the signing of the joint circulars provides an important legal foundation for the criminal investigation of the criminal investigation police agencies at all levels, as well as for the exercise of prosecution rights and judicial supervision when the district-level police agency no longer exists.

To effectively implement the joint circulars, the Minister of Public Security requested that all police units and agencies across the country should strictly comply with provisions stipulated in the joint circulars as well as strengthen their efforts to combat and suppress all types of crime.

He also requested relevant public security units to closely coordinate with functional units of ministries and sectors to regularly review and evaluate the implementation of the joint circulars and assist the executive agencies to overcome any difficulties and obstacles arising in the implementation of the circulars.
